Can I post photos of the person I’m putting on blast?
Ok read this part carefully. A lot of images appearing on dontdatethisfish.com are submitted by users who are prohibited from uploading images unless they are the lawful copyright owner (see copyright information). Other images may be obtained from third party sources only when doing so constitutes fair use under Section 107 of the U.S. Copyright Act; 17 U.S.C. § 107. So that means if someone has already posted a photo on social media – that’s fair game. But don’t upload some pornographic, nasty photo of anyone that you found God knows where. This also includes child porn or images of minors unless connected to a legitimate news story, revenge porn, someone’s personal financial information (i.e. social security numbers, bank account numbers, credit card numbers) or medical records. We don’t want to see any of it and frankly don’t care if someone else might. There are other sites for that. If you do try and post it, It will be removed and we could possibly block you.
Are there things I’m not allowed to post?
We’re providing a public service by letting you know just who is lurking about in your community and online. But we’re not trying to ruin anyone’s life. DO NOT POST FALSE, DEFAMATORY, OR OTHERWISE UNLAWFUL MATERIAL. Again, its your FIRST AMENDMENT right to make your opinion known. However you are legally responsible for your words, so please don’t lie.

- nudity, pornography or obscenity, including but not limited to “revenge porn”.
- threats of any form of violence/harm.
- images of minor children

ANY COMMENTS ATTACKING SOMEONEFOR THEIR SEXUAL ORIENTATION, GENDER IDENTITY, RACE, RELIGION, NATIONAL ORIGIN, OR PHYSICAL/MENTAL DISABILITY WILL RESULT IN AN IMMEDIATE BAN FROM THIS SITE.
If I find a post about myself or someone else that I know to be untrue, can I get it taken down?
Maybe, maybe not. Look at it this way – people who truly know you will not believe what someone else has written about you. And frankly, who cares about people who don’t know you? But for anyone who feels what someone posted about is untrue and/or disparaging in nature we will provide an opportunity to post a rebuttal. In fact – we want you to. If you can dish it out, well…..
However if that isn’t enough, there are two ways to possibly get a post removed. They are:
Court Order
If a court determines that a post contains false information and is not factual, it will be reviewed and subject to final editorial discretion, once reviewed it may be removed.
The Information Violates Our Policy
Without a court order, we will not consider removing a post unless it contains inappropriate images of a minor not connected to a legitimate news story or someone’s personal financial or medical information.
Can dontdatethisfish.com be sued for publishing false information?
No. Under a federal law known as the Communications Decency Act or “CDA”, sites like dontdatethisfish.com are generally not liable for “publishing” content from a third party user. Your beef isn’t with me – it’s with the person who posted the information you allege is false. So in short, sue the person who wrote it, not me. If you’re the person the person writing some really terrible mean and untrue things about people YOU CAN BE SUED. YOU SHOULD BE SUED. IF YOU DON”T WANT TO BE SUED MAKE SURE ITS CLEAR THAT THIS IS YOUR OPINION OR PLACE ALLEGEDLY SOMEWHERE IN YOUR CLAIMS.
Will you provide any information about the person who wrote it?
Yes, if you there’s a subpoena. The First Amendment protects the right to anonymous speech. This means that if a person posts something anonymously on dontdatethisfish.com they have the right to remain anonymous unless it is demonstrated you are legally entitled to learn their identity.
